
Erik J. Osterrieder
Erik Osterrieder is a Senior Attorney at Kearney, McWilliams & Davis, with over 20 years of experience in intellectual property. Mr. Osterrieder obtained a B.S. in Chemistry, cum laude, at the University of Louisville, undertook graduate studies in nuclear chemistry at the University of California, Berkeley, and obtained his law degree at the University of Dayton. In his spare time, Erik and his spouse enjoy travelling, having dinner with friends, and spending time with their dogs.
Mr. Osterrieder’s IP experience includes drafting and prosecuting hundreds of domestic and foreign patent, trademark, and copyright applications, as well as lodging and defending against European patent oppositions as well as US trademark oppositions and cancellations before the Trademark Trial and Appeal Board. Further, he has handled due diligence, reexaminations, reissues, post-issuance procedures, and appeals before both the Patent Trial and Appeal Board and U.S. Court of Appeals for the Federal Circuit. In addition to having litigated IP matters in all four federal districts in Texas, Erik routinely drafts and reviews assignments, licenses, non-disclosure agreements, joint-venture agreements, contracts, other agreements, and various types of opinion work, e.g., patentability, non-infringement, freedom-to-operate, invalidity, registrability, fair use, etc.
Erik is based in the Houston office of Kearney, McWilliams & Davis.
